FAKE ENCOUNTER CASES – TARLOCHAN SINGH: A FATHER’S LONELY BATTLE IN SEARCH OF JUSTICE  ਝੂਠੇ ਪੁਲਿਸ ਮੁਕਾਬਲੇ – ਤਰਲੋਚਨ ਸਿੰਘ – ਇੱਕ ਪਿਤਾ ਦੀ ਇਨਸਾਫ ਦੀ ਭਾਲ ਵਿੱਚ ਇਕੱਲਿਆਂ ਲੜਾਈ

Tarlochan Singh Sidhu, ex-principal of Khalsa Senior Secondary School in Kharar (Ropar) spent his life pursuing the police officers who killed his only child, Kulvinder Singh ‘Kid’. During this time, key witnesses died, others were intimidated by the police and important evidence was destroyed. Furthermore, none of the senior officers were charged for their role in Kulvinder’s killing.

Kulwinder Singh was 20 years old at the time of his murder. It was in 1985 when the police first began to detain and torture Kulwinder for his membership of the All India Sikh Students Federation. Whenever the police could not find Kulvinder, they would apprehend his family members instead. The police filed a number of false cases against Kulwinder Singh but he went into hiding to avoid the repeated torture. The police finally caught up with him in September 1986 and he was sent to Nabha High Security prison until October 1988 when he was released.

In February 1989 Kulvinder Singh got married and the couple moved into their new house in Phase 5 Mohali. However, their happiness was short-lived. On 22 July 1989 around 11am, a large number of policemen, many in plain clothes, laid siege to Kulwinder’s house. Kulvinder’s father received a worried phone call from a witness who had just seen the police forcefully enter and cordon off, Kulvinder’s house.

At the time, Principal Tarlochan Singh served on the ‘Committee Against Police Excesses’ which reported on police atrocities to Justice Ajit Singh Bains, chairman of the Punjab Human Rights Organisation. Tarlochan Singh along with a few of his associates, immediately made their way to Kulvinder’s house. At around 3pm as they neared the house, they saw Kulwinder Singh along with his friend Palwinder Singh ‘Pola’, walking down the lane towards the house. Suddenly, nine to ten policemen pounced on the duo and overpowered Kulwinder Singh, throwing him to the ground. Palwinder Singh tried to escape by jumping over a wall, but he was fired at by policemen stationed on the rooftops and was killed on the spot. Kulwinder Singh was dragged into a waiting jeep, blind-folded and with his hands and feet tied up. This was the last time Tarlochan Singh would ever see his son….

Tarlochan Singh, a very intelligent and educated man, knew how the corrupt system operated. He sent telegrams to the Chief Justice of the Punjab and Haryana High Court, the Governor of Panjab as well as the DGP of Panjab Police to prevent his son’s murder. His next step was to contact the daily ‘Panjabi Tribune’, where a reporter showed him a newly issued press release from the police stating that on the night before, Palwinder Singh ‘Pola’ had been killed in an encounter and Kulwinder Singh ‘Kid’ had escaped from the scene. It is suspected that Kulwinder Singh was later eliminated by SSP Surjit Grewal in a ‘fake encounter’ on Tangori Kurda Road in Sohana.

Tarlochan Singh spent more than two decades seeking justice for his son. He described the police abuse he suffered during all those years: “I used to receive threatening phone calls, saying they had killed thousands of boys and thrown them into canals and they would do the same to Kulwinder Singh’s wife, or me and my wife, if I did not drop the case”. None of the guilty officers were arrested or suspended. The trial proceeded with very little evidence being recorded and months would pass between hearings. In 2012, at the age of seventy three, Tarlochan Singh died from a heart attack. Shortly before his death, a Panjab & Haryana High Court judge had acquitted all of the accused police officers, granting them the ‘benefit of doubt’. Many of the policemen went on to be promoted or retired on lucrative packages, making a mockery of justice.

ਤਰਲੋਚਨ ਸਿੰਘ ਸਿੱਧੂ ਜੋ ਕਿ ਖਾਲਸਾ ਸੀਨੀਅਰ ਸੈਕੰਡਰੀ ਸਕੂਲ ਖਰੜ (ਰੋਪੜ) ਵਿੱਚੋਂ ਬਤੌਰ ਪ੍ਰਿਸੀਪਲ ਰਿਟਾਇਰ ਹੋਏ ਸਨ । ਉਹਨਾਂ ਨੇ ਆਪਣੀ ਜ਼ਿੰਦਗੀ ਆਪਣੇ ਇਕਲੌਤੇ ਪੁੱਤ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ‘ਕਿੱਡ’ ਦੇ ਕਾਤਲ ਪੁਲਿਸ ਅਫਸਰਾਂ ਨੂੰ ਸਜ਼ਾ ਦਿਵਾਉਣ ਲਈ ਲਾ ਦਿੱਤੀ । ਇਸ ਸਮੇਂ ਦੌਰਾਨ ਮੁੱਖ ਗਵਾਹਾਂ ਦੀ ਮੌਤ ਹੋ ਗਈ, ਹੋਰਾਂ ਨੂੰ ਪੁਲਿਸ ਵੱਲੋਂ ਧਮਕਾ ਦਿੱਤਾ ਗਿਆ ਅਤੇ ਮਹੱਤਵਪੂਰਨ ਸਬੂਤ ਤਬਾਹ ਕਰ ਦਿੱਤੇ ਗਏ । ਇਸ ਤੋਂ ਇਲਾਵਾ ਕਿਸੇ ਵੀ ਮੁੱਖ ਅਧਿਕਾਰੀ ਨੂੰ ਕਤਲ ਵਿੱਚ ਭੂਮਿਕਾ ਹੋਣ ਕਾਰਨ ਦੋਸ਼ੀ ਨਾ ਗਰਦਾਨਿਆ ਗਿਆ ।

ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੀ ਉਮਰ 20 ਸਾਲ ਸੀ ਜਦੋਂ ਉਸ ਦਾ ਕਤਲ ਕਰ ਦਿੱਤਾ ਗਿਆ । ਸੰਨ 1985 ਵਿੱਚ ਪਹਿਲੀ ਵਾਰ ਪੁਲਿਸ ਨੇ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਨੂੰ ਗ੍ਰਿਫਤਾਰ ਕਰਕੇ ਤਸ਼ੱਦਦ ਦਾ ਨਿਸ਼ਾਨਾ ਬਣਾਇਆ ਕਿਉਂਕਿ ਉਹ ਆਲ ਇੰਡੀਆਂ ਸਿੱਖ ਸਟੂਡੈਂਟ ਫੈਡਰੇਸ਼ਨ ਦਾ ਮੈਂਬਰ ਸੀ । ਜਦੋਂ ਵੀ ਪੁਲਿਸ ਨੂੰ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਨਾ ਮਿਲਦਾ ਤਾਂ ਉਹ ਘਰ ਦੇ ਮੈਂਬਰਾਂ ਨੂੰ ਚੁੱਕ ਕੇ ਲੈ ਜਾਂਦੇ । ਪੁਲਿਸ ਨੇ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਉੱਤੇ ਕਈ ਝੂਠੇ ਕੇਸ ਪਾ ਦਿੱਤੇ । ਇਸ ਲਈ ਪੁਲਿਸ ਦੇ ਤਸ਼ੱਦਦ ਤੋਂ ਬਚਣ ਲਈ ਉਹ ਰੂਪੋਸ਼ ਹੋ ਗਿਆ । ਪੁਲਿਸ ਨੇ ਆਖਰ ਸਤੰਬਰ 1986 ਵਿੱਚ ਉਸਨੂੰ ਗ੍ਰਿਫਤਾਰ ਕਰ ਲਿਆ ਤੇ ਉਸ ਨੂੰ ਨਾਭਾ ਸਕਿਉਰਿਟੀ ਜੇਲ੍ਹ ਵਿੱਚ ਭੇਜ ਦਿੱਤਾ ਗਿਆ । ਅਕਤੂਬਰ 1988 ਵਿੱਚ ਉਹ ਰਿਹਾਅ ਹੋ ਗਿਆ ।

ਫਰਵਰੀ 1989 ਨੂੰ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦਾ ਵਿਆਹ ਹੋ ਗਿਆ ਤੇ ਉਹ ਆਪਣੀ ਪਤਨੀ ਨਾਲ ਮੋਹਾਲੀ ਦੇ ਫੇਸ ਪੰਜ ਵਿੱਚ ਰਹਿਣ ਲੱਗਾ । ਪਰ ਉਸਦੀ ਇਹ ਨਵੀਂ ਖੁਸ਼ੀ ਥੋੜ ਚਿਰੀ ਸੀ । 22 ਜੁਲਾਈ 1989 ਨੂੰ 11 ਵਜੇ ਦੇ ਆਸ ਪਾਸ ਪੁਲਿਸ ਦੀ ਧਾੜ ਨੇ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੇ ਘਰ ਨੂੰ ਘੇਰਾ ਪਾ ਲਿਆ । ਉਨ੍ਹਾਂ ਵਿੱਚ ਬਹੁਤੇ ਪੁਲਿਸ ਵਾਲੇ ਬਿਨਾਂ ਵਰਦੀ ਤੋਂ ਸਨ । ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੇ ਪਿਤਾ ਨੂੰ ਮੌਕੇ ਤੋਂ ਇੱਕ ਵਿਅਕਤੀ ਨੇ ਫੋਨ ਕਰਕੇ ਦੱਸਿਆ ਕਿ ਉਸਦੇ ਘਰ ਵਿੱਚ ਪੁਲਿਸ ਜ਼ਬਰਦਸਤੀ ਦਾਖਲ ਹੋ ਗਈ ਹੈ ।

ਪ੍ਰਿੰਸੀਪਲ ਤਰਲੋਚਨ ਸਿੰਘ ਨੇ ”ਕਮੇਟੀ ਅਗੇਂਸਟ ਪੁਲਿਸ ਐਕਸੈਸਜ਼” ਵਿੱਚ ਕੰਮ ਕੀਤਾ ਸੀ ਜੋ ਕਿ ਪੁਲਿਸ ਦੇ ਧੱਕਿਆਂ ਦੀ ਰਿਪੋਰਟ ਨੂੰ ਜਸਟਿਸ ਅਜੀਤ ਸਿੰਘ ਬੈਂਸ ਨੂੰ ਭੇਜਦੇ ਸਨ ਜੋ ਕਿ ਪੰਜਾਬ ਹਿਊਮਨ ਰਾਈਟਜ਼ ਆਰਗੇਨਾਈਜ਼ੇਸ਼ਨ ਦੇ ਚੈਅਰਮੈਨ ਸਨ । ਤਰਲੋਚਨ ਸਿੰਘ ਨੇ ਜਲਦ ਹੀ ਆਪਣੇ ਕੁਝ ਸਾਥੀਆਂ ਨਾਲ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੇ ਘਰ ਵੱਲ ਰੁੱਖ ਕੀਤਾ । 3 ਵਜੇ ਜਦੋਂ ਉਹ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੇ ਘਰ ਦੇ ਨਜ਼ਦੀਕ ਪਹੁੰਚੇ ਤਾਂ ਉਹਨਾਂ ਨੇ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਤੇ ਅਤੇ ਉਸਦੇ ਮਿੱਤਰ ਪਲਵਿੰਦਰ ਸਿੰਘ ‘ਪੋਲਾ’ ਨੂੰ ਸੜਕ ਕਿਨਾਰੇ ਆਪਣੇ ਘਰ ਵੱਲ ਜਾਂਦਿਆਂ ਨੂੰ ਦੇਖਿਆ । ਅਚਾਨਕ ਹੀ 9 – 10 ਪੁਲਿਸ ਵਾਲੇ ਦੋਨਾਂ ਉੱਤੇ ਝਪਟ ਪਏ ਅਤੇ ਉਹਨਾਂ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਨੂੰ ਕਾਬੂ ਕਰ ਕੇ ਜ਼ਮੀਨ ਉੱਤੇ ਸਿੱਟ ਲਿਆ । ਪਲਵਿੰਦਰ ਸਿੰਘ ਨੇ ਕੰਧ ਤੋਂ ਛਾਲ ਮਾਰ ਕੇ ਬਚਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ ਪਰ ਛੱਤ ਤੇ ਪੁਜ਼ੀਸ਼ਨਾਂ ਲਈ ਬੈਠੇ ਪੁਲਿਸ ਵਾਲਿਆਂ ਨੇ ਉਸ ਉੱਤੇ ਗੋਲੀਆਂ ਦੀ ਬੁਛਾੜ ਕਰ ਦਿੱਤੀ ਤੇ ਉਹ ਥਾਏਂ ਹੀ ਮਾਰਿਆ ਗਿਆ । ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੀਆਂ ਅੱਖਾਂ ਤੇ ਪੱਟੀਆਂ ਬੰਨ ਦਿੱਤੀਆਂ ਗਈਆਂ, ਉਸ ਦੇ ਹੱਥ ਪੈਰ ਨੂੜ ਦਿੱਤੇ ਗਏ ਤੇ ਉਹਨੂੰ ਘੜੀਸ ਕੇ ਜੀਪ ਵਿੱਚ ਸੁੱਟ ਦਿੱਤਾ ਗਿਆ । ਇਹ ਆਖਰੀ ਵਾਰ ਸੀ ਜਦੋਂ ਤਰਲੋਚਨ ਸਿੰਘ ਨੇ ਆਪਣੇ ਪੁੱਤ ਨੂੰ ਦੇਖਿਆ……..

ਤਰਲੋਚਨ ਸਿੰਘ ਇੱਕ ਬੁੱਧੀਮਾਨ ਤੇ ਪੜ੍ਹਿਆ ਲਿਖਿਆ ਇਨਸਾਨ ਸੀ । ਉਹਨਾਂ ਨੂੰ ਪਤਾ ਸੀ ਕਿ ਇਹ ਭ੍ਰਿਸ਼ਟ ਸਿਸਟਮ ਕਿਸ ਤਰ੍ਹਾਂ ਕੰਮ ਕਰਦਾ ਹੈ । ਉਸ ਨੇ ਆਪਣੇ ਪੁੱਤ ਨੂੰ ਕਤਲ ਤੋਂ ਬਚਾਉਣ ਲਈ ਪੰਜਾਬ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਚੀਫ ਜਸਟਿਸ, ਗਵਰਨਰ ਪੰਜਾਬ ਅਤੇ ਪੰਜਾਬ ਪੁਲਿਸ ਦੇ ਮੁਖੀ ਨੂੰ ਟੈਲੀਗਰਾਮਾਂ ਕੀਤੀਆਂ । ਉਹਨਾਂ ਦਾ ਅਗਲਾ ਕਦਮ ਇੱਕ ਰੋਜ਼ਾਨਾ ਅਖਬਾਰ ”ਪੰਜਾਬ ਟ੍ਰਿਬਿਊਨ” ਨਾਲ ਸੰਪਰਕ ਕਰਨਾ ਸੀ ।ਅਖਬਾਰ ਦੇ ਇੱਕ ਪੱਤਰਕਾਰ ਨੇ ਪੁਲਿਸ ਦਵਾਰਾ ਤਾਜ਼ੀ ਜਾਰੀ ਕੀਤੀ ਇੱਕ ਪ੍ਰੈਸ ਸਟੇਟਮੈਂਟ ਉਹਨਾਂ ਨੂੰ ਦਿਖਾਈ ਜਿਸ ਵਿੱਚ ਪੁਲਿਸ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਸੀ ਕਿ ਇੱਕ ਮੁਕਾਬਲੇ ਵਿੱਚ ਪਲਵਿੰਦਰ ਸਿੰਘ ‘ਪੋਲਾ’ ਮਾਰਿਆ ਗਿਆ ਤੇ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ‘ਕਿੱਡ’ ਮੌਕੇ ਤੋਂ ਫਰਾਰ ਹੋ ਗਿਆ । ਇਹ ਪ੍ਰੈਸ ਰਿਲੀਜ਼ ਐਸ ਐਸ ਪੀ ਗਰੇਵਾਲ ਨੇ ਜਾਰੀ ਕੀਤੀ ਜੋ ਕਿ ਪਟਿਆਲਾ ਸਮੇਤ 6 ਹੋਰ ਸੀ ਆਈ ਏ ਸਟਾਫਾਂ ਦਾ ਇੰਚਾਰਜ ਸੀ । ਇਸ ਗੱਲ ਦਾ ਸ਼ੱਕ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਐਸ ਐਸ ਪੀ ਸੁਰਜੀਤ ਗਰੇਵਾਲ ਵੱਲੋਂ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਨੂੰ ਝੂਠੇ ਪੁਲਿਸ ਮੁਕਾਬਲੇ ਵਿੱਚ ਖਤਮ ਕਰ ਦਿੱਤਾ ਜੋ ਕਿ ਟੰਗੋਰੀ ਖੁਰਦਾ ਰੋਡ ਸੋਹਾਨਾ ਵਿੱਚ ਹੋਇਆ ਦਿਖਾਇਆ ਗਿਆ ਸੀ ।

ਤਰਲੋਚਨ ਸਿੰਘ ਨੇ ਦੋ ਦਹਾਕਿਆਂ ਦਾ ਸਮਾਂ ਆਪਣੇ ਪੁੱਤ ਲਈ ਇਨਸਾਫ ਲੈਣ ਲਈ ਗੁਜ਼ਾਰਿਆ । ਉਹਨਾਂ ਨੇ ਪੁਲਿਸ ਵੱਲੋਂ ਇਸ ਸਮੇਂ ਦੌਰਾਨ ਕੀਤੀ ਬਦਸਲੂਕੀ ਨੂੰ ਇਸ ਤਰ੍ਹਾਂ ਵਰਨਣ ਕੀਤਾ ” ਮੈਨੂੰ ਧਮਕੀ ਭਰੇ ਫੋਨ ਆਉਂਦੇ ਸਨ ਜੋ ਕਿ ਮੈਨੂੰ ਕਹਿੰਦੇ ਸਨ ਕਿ ਅਸੀਂ ਹਜ਼ਾਰਾਂ ਨੌਜਵਾਨਾਂ ਨੂੰ ਮਾਰ ਕੇ ਨਹਿਰਾਂ ਵਿੱਚ ਸੁੱਟ ਦਿੱਤਾ ਹੈ ਜੇ ਤੁਸੀਂ ਆਪਣੇ ਕੇਸ ਵਾਪਸ ਨਾ ਲਏ ਤਾਂ ਕੁਲਵਿੰਦਰ ਸਿੰਘ ਦੀ ਤਰ੍ਹਾਂ ਉਸ ਦੀ ਪਤਨੀ ਜਾਂ ਮੈਨੂੰ ਤੇ ਮੇਰੀ ਪਤਨੀ ਨਾਲ ਵੀ ਉਸੇ ਤਰ੍ਹਾਂ ਹੀ ਕੀਤਾ ਜਾਵੇਗਾ । ਕਿਸੇ ਵੀ ਦੋਸ਼ੀ ਪੁਲਿਸ ਅਫਸਰ ਨੂੰ ਗ੍ਰਿਫਤਾਰ ਜਾਂ ਸਸਪੈਂਡ ਨਾ ਕੀਤਾ ਗਿਆ ।ਮੁਕੱਦਮਾ ਬਹੁਤ ਹੌਲੀ ਹੌਲੀ ਅਗੇ ਚੱਲਿਆ । ਬਹੁਤ ਘੱਟ ਸਬੂਤ ਰਿਕਾਰਡ ਹੋਏ । ਸੁਣਵਾਈ ਵਿਚਕਾਰ ਮਹੀਨਿਆਂ ਦਾ ਸਮਾਂ ਲੰਘ ਜਾਂਦਾ ਸੀ । ਸੰਨ 2012 ਵਿੱਚ ਤਰਲੋਚਨ ਸਿੰਘ ਦੀ ਦਿਲ ਦੇ ਦੌਰੇ ਨਾਲ ਮੌਤ ਹੋ ਗਈ । ਉਨ੍ਹਾਂ ਦੀ ਮੌਤ ਤੋਂ ਕੁਝ ਸਮਾਂ ਪਹਿਲਾਂ ਪੰਜਾਬ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਦੇ ਇੱਕ ਜੱਜ ਨੇ ਸਾਰੇ ਦੋਸ਼ੀ ਪੁਲਿਸ ਅਫਸਰਾਂ ਨੂੰ ”ਸ਼ੱਕ ਦੇ ਲਾਭ” ਤਹਿਤ ਬਰੀ ਕਰ ਦਿੱਤਾ ਗਿਆ । ਬਹੁਤੇ ਪੁਲਿਸ ਵਾਲਿਆ ਨੂੰ ਬਾਅਦ ਵਿੱਚ ਤਰੱਕੀ ਵੀ ਮਿਲੀ । ਇਹ ਸਭ ਕੁਝ ਇਨਸਾਫ ਨਾਲ ਮਜ਼ਾਕ ਹੈ ।
